AstapovLawyers succeeds in a GAFTA arbitration involving their Kazakh client
The GAFTA arbitration tribunal has rendered an award in favour of AstapovLawyers' client, one of the largest agricultural producers and traders in Kazakhstan, in a long-lasting arbitration case against an importer from Germany.
This complicated case concerned a number of issues of applicable Kazakh and English law, insurance law and acceptance of damaged goods delivered under a CIF contract. The first tier award published in November 2009 contained quite odd findings giving a respondent an award where there had been neither counterclaim nor request for a set-off.
At the appeal stage, the Board of GAFTA arbitrators has taken the well argued position of AstapovLawyers' client and set aside the first tier award granting relief to the claiming party only.
