EXPERT CLAUSE
of the International Centre of Judicial and ADR Expertise under the INA "European Arbitration Chamber" (Brussels, Belgium)
At the moment of signing this Agreement, the parties have agreed that from the beginning of execution of works and till the completion of works under this Agreement an expert-mediator of the International Centre of Judicial and ADR Expertise under the International non-profit association "European Arbitration Chamber" (Belgium, Brussels, Avenue Louise 146) (hereinafter - "ICJE under the EAC") shall be appointed in accordance with the terms of this Agreement and Statute of the ICJE under the EAC as an accompanying expert-mediator for a technical control and possible consideration of any disputes, which may arise in connection with the execution of technical tasks of this Agreement.
Terms of payment of the expert's work shall be agreed in a separate tripartite contract between the parties of this Agreement and the ICJE under the EAC, where form, amount and distribution of payment of work of the expert-mediator between the parties shall be determined.
If as result of the implementation of this Agreement any dispute of a technical or legal nature arises, this dispute can be settled by an expert-mediator ICJE under the EAC in accordance with its Statute.
If the expert-mediator for any reason cannot consider this dispute, it can be considered by the International Commercial Arbitration Court under the International non-profit association "European Arbitration Chamber" (Belgium, Brussels, Avenue Louise 146) (hereinafter - "the ICAC under the EAC") in accordance with its Rules.
The number of arbitrators shall be one, who shall be appointed by the President of the ICAC under the EAC.
The seat, or legal place, of arbitration shall be [city and/or country].
The language to be used in the arbitral proceedings shall be [___ ].
The governing law of the contract shall be the substantive law of [country]."
